Thank you for using ShareIMG! By signing up for a free ShareIMG account, you agree to the Terms of Service and Privacy Policy set forth here (the “Terms”). ShareIMG reserves the rights to alter, modify, or supplement the Terms at any time, with or without notice to ShareIMG users or subscribers. Once you receive confirmation that your free ShareIMG account is active, you become a subscriber of ShareIMG and these Terms become binding on you. If you do not agree to any of the Terms, you must cease using or accessing ShareIMG or any content stored or hosted by ShareIMG in any capacity. These Terms do not create any contractual relationship with any person who has not signed up for a free ShareIMG account and received a confirmation that their account is active (including any persons who, without signing up for an account, simply visit the ShareIMG website or receive content shared by a ShareIMG subscriber).
Paid subscribers of ShareIMG are subject to additional terms, as further set forth in our ShareIMG Paid Subscriber Agreement.
All users or subscribers of ShareIMG must be at least the age of 16 and agree not to use ShareIMG for any illegal or purposes. Users and subscribers agree not to use ShareIMG to store or share any content that is illegal (including content that infringes on any other person’s copyright, trademark, patent, trade secret, or other intellectual property), obscene, pornographic, indecent, destructive, harmful (including content that contains viruses, malware, or Trojan horses). Users and subscribers further agree not to use ShareIMG for any illegal, libelous, defamatory, pornographic, obscene, indecent deceptive, tortious, fraudulent, hateful, abusive, threatening purpose, or to promote or encourage illegal activity, violence, or violations of privacy. We reserve the right to review any content or information stored on ShareIMG servers to ensure compliance with the Terms and all applicable laws. If a copyright complaint is made to us, we will provide you with notice of the complaint and offer you a chance to respond before deleting any content.
Any violations of the Terms may result in immediate deletion of all a subscriber’s content and immediate termination of our services. “Content,” as used in these Terms, refers to any images, videos, audio files, or any other type of file or information a subscriber has uploaded to ShareIMG’s website or shares with another person through ShareIMG’s services.
Free ShareIMG accounts are intended for personal, individual use only, and any commercial or business use of our services is strictly prohibited. If you are interested in using ShareIMG on behalf of a business, enterprise, or organization, please contact us for pricing and options.
All content you upload to ShareIMG or share through ShareIMG belongs to you. Uploading content to ShareIMG doesn’t make it ours, and we don’t obtain any rights or interests in your content by virtue of it being stored on our servers. You expressly give us permission, however, to do what’s necessary to provide you with ShareIMG services, including storing, hosting, reproducing, and displaying your content.
All users and subscribers use ShareIMG at their own risk. To the fullest extent permitted by law, ShareIMG makes no warranties, either express or implied, about the services it offers, or their reliability, availability, or fitness for any particular purpose. We disclaim all warranties to the extent permitted by law.
You are responsible for all content that you upload to ShareIMG servers, including for intellectual property claims. By uploading or sharing content through ShareIMG, you represent that you have all valid rights, permissions, licenses, and consents to share the content and that doing so doesn’t violate the rights of any others.
ShareIMG is not liable or responsible for any act or omission of its users or subscribers or for any content hosted on its site by users or subscribers. By using this site, you and your heirs, assigns, and successors hereby indemnify and hold harmless ShareIMG and its principals, directors, officers, employees, agents, equity holders, parents, subsidiaries, and affiliates from any liabilities, allegations, suits, demands, expenses, damages, claims, causes of action, obligations (including court costs and attorneys’ fees) whatsoever, either known or unknown, that arise out of or relate to any act or omission of any of ShareIMG’s users or subscribers or the content that ShareIMG’s users or subscribers upload to ShareIMG’s site. You expressly waive any rights you may have under California Civil Code Section 1542 or any similar law.
ShareIMG does not guarantee that any files hosted on its servers are free of viruses or malware, nor does it guarantee that any act or omission of any ShareIMG user or subscriber complies with any law. If any user or subscriber suspects that content hosted at ShareIMG is harmful, illegal, or violates these Terms of Service, please notify us immediately.
ShareIMG will make efforts to make your content available at all times, 24 hours a day, 7 days a week. Nevertheless, sometimes foreseen or unforeseen circumstances—such as maintenance, server interruptions or updates, damage, or third-party actions—may make your content unavailable for some period of time. ShareIMG is not responsible or liable for any loss or damage that arises from any circumstance that renders your content unavailable or unaccessible.
ShareIMG respects the rights of copyright holders. If you discover or suspect that a ShareIMG user or subscriber is distributing works in which you hold a valid copyright or trademark without your consent, please contact us immediately. Please provide a detailed description of the work, your contact information, and information sufficient for us to determine whether you hold valid intellectual property in the work at issue.
You may stop using ShareIMG at any time by signing into your account and cancelling your service. We reserve the right to suspend or terminate your account and/or your ability to use ShareIMG’s services if you violate any of the Terms; if your use of ShareIMG’s services causes harm, loss, or the risk of harm or loss to any other person, as determined by ShareIMG in its sole discretion; or if you have not accessed ShareIMG’s services for six (6) consecutive months. Before terminating an account for non-use, we will contact you at the email address you provided and give you an opportunity to keep your account active.
These Terms, together with any other legal notices published on ShareIMG’s website, will be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflicts-of-laws rules. All subscribers of ShareIMG agree that any and all judicial proceedings arising out of ShareIMG’s Terms must be brought in the United States District Court for the Eastern District of Virginia, or in a state court located in Fairfax County, Virginia. In any dispute arising out of these Terms, ShareIMG and its subscribers waive their right to a trial by jury to the greatest extent permitted by law. To the greatest extent permitted by law, you agree that you will bring disputes only on an individual basis and you expressly agree not to bring any class, consolidated, or representative action.
The Terms constitute the entire agreement between ShareIMG and you, the ShareIMG subscriber. If any provision of these Terms is determined to be unenforceable or invalid, all other valid and enforceable parts of these Terms will remain in full force and effect.
We don’t sell your personal data. Period.
In order to better understand our users, subscribers, and visitors and their behavior, to improve the quality of our services, and for other purposes, we collect transactional information about users, subscribers, and visitors —including IP addresses, time and date of visit, information about computers and mobile devices such as manufacturer and operating system, size and amount of content stored on ShareIMG, pages on ShareIMG that subscribers and visitors access, and data regarding system-generated error messages. We do not sell this data to other companies. Period.
ShareIMG may use cookies to improve the experience of the users and subscribers of our services and people who visit our website.
